1. Tribunal's Fee

1.1 The tribunal, when convened to undertake an independent neutral evaluation under the Regulations, will normally consist of one member who will charge an hourly fee of £250 including travelling time, plus travel and reasonable out of pocket expenses at cost.

1.2 The parties to the dispute are jointly and severally responsible for these fees but the tribunal may allocate the costs between the parties as part of the determination. The tribunal’s fees and other costs will be paid through the Chartered Institute of Arbitrators.

2. Expert's or Adviser's Fee

2.1 In accordance with Regulation 7.1, the tribunal may appoint experts or legal advisers or assessors to assist it in reaching a fair and reasonable determination. In such circumstances, the tribunal may include any or all such expenses in the allocation of costs as set out in Regulation 10.3.

3. Registration Fee and Security Costs

3.1 The party making the application shall pay to the Institute, in advance, a registration fee of £1,400 plus VAT and a payment of £5,000 for Security of Costs in respect of the tribunal’s fees only.

4. Ancillary Administration Costs

4.1 In the course of hearing an application for determination under the regulations, the tribunal may incur ancillary costs for the hire of hearing rooms, use of technology etc.

4.2 The parties to the dispute are jointly and severally responsible for these costs but the tribunal may allocate such costs between the parties as part of the determination. These costs will be paid through the Chartered Institute of Arbitrators.
