Law No 6 for 2002 Concerning the Formation and Protection of the Telecommunication Network for Dubai Internet City
We Maktoum Bin Rashid Al Maktoum, the Ruler of Dubai,
Having reviewed Law No 1 for 2000, for establishing the Dubai Technology and Media Free Zone Authority, we decreed as follows:
Article One
This Law shall be referred to as “Law No 6 for 2002 concerning the formation and Protection of the Telecommunication Network for Dubai Internet City”.
Article Two
The following words and expressions shall have the meanings assigned to, unless otherwise implied by the text.
“The Government: means The Government of the Emirate of Dubai.
“The Emirate” means The Emirate of Dubai.
“Dubai Internet City” means Dubai Internet City being part of Dubai Technology, Electronic Commerce and Media Free Zone.
“The Municipality” means Dubai Municipality.
“Telecommunication Network” means The Telecommunication System of Dubai Internet City.
“The Person” means any legal or natural person.
Article Three
The Dubai Internet City shall provide telecommunication services via fiver optics network, and fixed and Ariel stations to be operated, maintained and developed by the Dubai Internet City, for the purpose of serving the objectives of companies, establishments and persons in the Emirate.
Article Four
The Municipality shall provide service passages on the roads and streets of the Emirate specifically for the telecommunication network, in addition to all other facilities necessary to enable Dubai Internet City to achieve the objectives referred to in Article Three of this Law. This shall include assigning lands, passages, coastal links for service channels, installation of fixed and Ariel stations, establishing networks and any other services necessary to achieve the objectives of Dubai Internet City.
Article Five
Any person carrying out any works in the vicinity of the telecommunication network, including fixed and Ariel stations, service passages or the channels related to the network, must take all necessary steps and precautions to avoid causing any damage or affect the integrity and safety of the passages, channels and network.
Article Six
Any person wishing to carry out any excavations, buildings or construction works in the vicinity of the telecommunication network, service passages or the channels related thereto, must obtain, prior to the commencement of the said works, a “No Objection Certificate” from Dubai Internet City, and to adhere to the provisions and instructions provided in the “No Objection Certificate”.
Article Seven
If any works planned by any person requires intersecting the telecommunication network, service passages or channels related thereto, he must inform Dubai Internet City in order to obtain its formal approval. He may not exercise any works prior to the attendance of a representative of the said City to determine the methods of executing or supervising the works.
Article Eight
It is prohibited for any person to interfere with the telecommunication network, service passages or channels related thereto, or with the fixed and Ariel stations, in a manner which results in their destruction, disconnection, stripping or scratching. Upon the occurrence of such event, such person must immediately notify the Dubai Internet City.
Article Nine
Without prejudice to any penalties provided by any other law, any person who violates the provisions of this Law, whether being a direct actor, an involved participant or contractor, shall be considered to have committed a crime which is punishable by imprisonment for a maximum period of six months and a fine of no less than 10,000 Dirhams and no more than 100,000 Dirhams, or by either of the two punishments. Such person shall also be liable for compensation for the damages arising from the crime, in accordance with the attached Compensation Schedule. The Court may also adjudge confiscation of the means used in committing the crime.
Article Ten
Any person who embezzles, steals, transfers, or without right, exploits the services of the telecommunication network, or related service passages or channels, shall be punished by imprisonment for a maximum term of six months and by a fine not exceeding 50,000 Dirhams, or by either of the two punishments.
Article Eleven
The amount of compensation adjudicated in accordance with the provisions of this Law shall be paid to Dubai Internet City.
Article Twelve
This Law shall be published in the official Gazette and shall come into force from the date of its publication.
