Decision No. 4 of 2008
Concerning Amendment of Decision No.1 of 2008, Additional Licensing Requirements for Certain Licensees under the Publishing Segment, and Penalties for Breach of such Additional Licensing Requirements, pursuant to the Dubai Technology and Media Free Zone Licensing Regulations 2003

I, Ahmad Binbyat, Director General of the Dubai Technology and Media Free Zone Authority

After perusal of the Dubai Technology and Media Free Zone Licensing Regulations 2003 (the "Licensing Regulations") and Regulations, 18.1, 21.1 and  31 thereunder, and after perusal of Decision No.1 of 2008, hereby issue the following decision regarding Additional Licensing Requirements for Certain Licensees under the Publishing Segment, and Penalties for Breach of such Additional Licensing Requirements, pursuant to the Licensing Regulations.


  1. This Decision is applicable to Licensees holding a Licence under the Publishing Segment (hereinafter, for the purposes of this Decision, ("Publishers" or a "Publisher"), being Segment 4.4 in Decision No.1 of 2008 (the "Licensing Categories Decision") issued pursuant to the Licensing Regulations (and any equivalent activities and segment in any update of the Licensing Categories Decision).
  2. Note 2.5 of the Licensing Categories Decision is deleted in entirety and replaced with the following:

    For licensees under the Publishing Segment (Segment 4.4 in Decision No.1 of 2008), a licensee is required to add the names of each of its publication titles to its licence. A licensee shall not publish any title unless and until that title has been added to its licence. A licensee shall pay an annual fee of United Arab Emirates Dirhams Five Thousand (AED 5,000.00) per title on its licence.

  3. The following additional requirements, and penalties for breach of such additional requirements, shall apply to Publishers:

    3.1 Prior to production and distribution of any publication by a Publisher (each such publication being a "Title"), a Publisher shall provide to the Authority a proposal for such Title, setting out the intended content, style and make-up of such Title for registration with the Authority. A Publisher shall not proceed to publish any Title unless and until the Title is registered with the Authority. Where a Publisher fails to comply with this requirement, the Authority may impose, and the Publisher shall pay, a penalty of United Arab Emirates Dirhams One Hundred Thousand (AED 100,000.00) for each such failure to comply. Nothing in this Article 3.1 shall otherwise limit any actions of the Authority under Regulation 10.1 of the Licensing Regulations.
    3.2 Prior to publication and distribution of any issue of any Title, a Publisher shall apply to add the Title to its Licence in compliance with Note 2.5 to the Licensing Categories Decision. Where a Publisher fails to comply with this requirement, the Authority may impose, and the Publisher shall pay, a penalty of United Arab Emirates Dirhams One Hundred Thousand (AED 100,000.00) for each such failure to comply. Nothing in this Article 3.2 shall otherwise limit any actions of the Authority under Regulation 10.1 of the Licensing Regulations
    3.3 Prior to distribution of any issue of any Title in the United Arab Emirates, a Publisher shall appoint a Distributor for that Title in the United Arab Emirates. (A "Distributor" is a person duly licensed by the relevant business authorities to import and distribute publications within the United Arab Emirates). Where a Publisher fails to comply with this requirement, the Authority may impose, and the Publisher shall pay, a penalty of United Arab Emirates Dirhams Ten Thousand (AED 10,000.00) for each such failure to comply. Nothing in this Article 3.4 shall otherwise limit any actions of the Authority under Regulation 10.1 of the Licensing Regulations.
    3.4 A Publisher shall supply to the Authority evidence of appointment of each Distributor. Where a Publisher fails to comply with this requirement, the Authority may impose, and the Publisher shall pay, a penalty of United Arab Emirates Dirhams Five Thousand (AED 5,000.00) for each such failure to comply. Nothing in this Article 3.5 shall otherwise limit any actions of the Authority under Regulation 10.1 of the Licensing Regulations.
    3.5 Prior to distribution of any issue of any Title, a Publisher shall provide to the Authority a copy of each issue of a Title at least two (2) days prior to the date of intended distribution of such issue of a Title. Where a Publisher fails to comply with this requirement, the Authority may impose, and the Publisher shall pay, a penalty of United Arab Emirates Dirhams Five Thousand (AED 5,000.00) for each such failure to comply. Nothing in this Article 3.3 shall otherwise limit any actions of the Authority under Regulation 10.1 of the Licensing Regulations.
  4. A Publisher shall pay any penalty imposed under this Decision within 21 days of being notified of the imposition of a penalty. Monies received by the Authority from a Publisher shall be applied firstly against any penalty due, and thereafter against the Licence Fee or any other amounts due to the Authority by the Publisher. The Authority may at its discretion refuse to renew a Licence for a Publisher in accordance with its discretionary powers as set out in the Licensing Regulations, where a penalty remains outstanding. 
  5. In addition to the imposition of a penalty as set out in this Decision, the Authority may refuse to provide any governmental services, including sponsorship services as described in Article 4 of the Dubai Technology and Media Free Zone Employment Regulations 2004 (the "Employment Regulations"). 

This Decision shall come into effect on the date of its issuance.
